NJ high court hearing case on witness intimidation
New Jersey's highest court is grappling with one of the thorniest issues facing criminal justice today: what to do in cases where witnesses to a crime have been threatened or intimidated by defendants to the point where they refuse to testify in court.
The issue is a pressing one in areas where intimidation by gang members, drug dealers and other defendants is making potential witnesses afraid they or their loved ones will be harmed or killed if they take the stand.
The state Supreme Court in Trenton heard nearly two hours of arguments Monday on a case that deals with what the state Attorney General's Office calls 'the greatest threat' to prosecution in gang, organized crime and domestic violence cases.

Burris determined to take his Senate seat Tuesday
Barack Obama's appointed successor declared Tuesday he's qualified to take a seat in the Senate and said he'll go to Capitol Hill to do just that.
'I'm presenting myself as the legally appointed senator from the state of Illinois. It is my hope and prayer that they recognize that the appointment is legal,' Roland Burris said in a nationally broadcast interview just hours before the Senate convenes with the start of the 111th Congress.
Burris dismissed the Senate Democratic leadership's position that he cannot be seated because he was appointed by a governor accused in a criminal complaint of trying to benefit financially from his authority to fill the seat that Obama vacated after winning the presidential election.

Manfred Nowak told Austrian radio more nations need to show 'solidarity' with the incoming government of President-elect Barack Obama, who has vowed to shut Guantanamo once he takes office.
